1. General information

These Terms of Service (”Terms”) govern the access and use of the internet website, the address of which is https://getpass.io (hereinafter „Website“), ****including the software provided on or in connection with those services (hereinafter collectively, “Services”). For more information about us as the provider of the Services (hereinafter „we“ or "GetPass"), please refer to the Website.

The subject matter of these Terms is the regulation of the rights and obligations of the users of the Website and Services. GetPass is an interface that operates exclusively on the basis of the Ethereum blockchain using a decentralized application distinguishing it from a trader, contractor, broker, seller, financial institution or credit provider. The software provides legally binding purchase agreements per smart contract. In addition, GetPass does not store, send, or receive digital assets or digital goods.

Each time the user accesses the Website, the user irrevocably agrees to comply with these Terms posted on this Website. If the user does not agree to any of the provisions set out in these Terms, the user should not use the Website or Services.

2. User acknowledgements

All transactions on the platform are conducted in ERC-20 tokens based on Ethereum blockchain. GetPass is neither a part of the Ethereum organization nor directly affiliated with its business activities. We can therefore neither guarantee availability of the Ethereum blockchain including its technical and software elements 100% of the time nor its proper functioning with regard to every individual transaction. This limitation specifically includes situations where a third party receives unauthorized access to any and all transactions, assets or files.

In addition, all transactions resulting in sales are based on smart contracts and blockchain technology that lack a 100% technical perfection guarantee by design. Users therefore acknowledge and agree that such technologies can contain inherent technology and speculation risks.

The user understands that GetPass neither own nor control any other third-party site, product, or service that they might access, visit, or use outside of GetPass. GetPass will not be liable for the acts or omissions of any such third parties, nor will we be liable for any damage that you may suffer because of your transactions or any other interaction with any such third parties.

3. Eligibility

To access or use the front-end interface, you represent that you are at least the age of majority in your jurisdiction. You further represent that your access and use of the front-end interface will fully comply with all applicable laws and regulations and that you will not access or use the front-end interface to conduct, promote, or otherwise facilitate any illegal activity. Furthermore, you represent that neither you nor any entity you represent are included in any trade embargoes or sanctions list, nor resident, citizen, national or agent of, or an entity organized, incorporated or doing business in such territories.

4. Disclaimer

All materials on the Website are for informational purposes only. Neither GetPass, nor any of the persons or entities involved in any way in respect of the Website provide for legal, fiscal, trading, economical and/or any other kind of advice or recommendation that may be relied upon. It means that the information from the Website cannot be used as a basis of investment strategy and nothing in this information can be ensured to contain no errors, mistakes, mispresentations or failures.

Users will therefore act at their own risk in accessing or in any way relying on the content of the Website and the users are therefore solely responsible for any consequences thereof.

5. Proprietary rights

We own the intellectual property generated by core contributors to GetPass for the use of GetPass, including but not limited to software, text, designs, images, and copyrights. Unless otherwise stated, GetPass reserves exclusive rights to its intellectual property and no part of the Website and Services and no content indicated therein may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, website or other medium for publication or distribution for any commercial purpose, without GetPass’s express prior written consent.

6. Violation of the Terms

GetPass may disclose any information it has about the user if it determines that such disclosure is necessary in connection with any investigation or complaint regarding the use of the Website, or to identify, contact or bring legal action against someone who may be causing injury to or interference with GetPass’s rights or property. GetPass also may disclose such information when applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

If GetPass does take any legal action against the user as a result of their violation of these Terms, GetPass will be entitled to recover from all reasonable fees and costs of such action.

7. Changes to the Terms

GetPass reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, GetPass will provide at least 30 days notice prior to any new terms taking effect. The continued use of the Website and Services after the end of notification period will constitute an acceptance of the revised Terms. What constitutes a material change is determined at GetPass’s sole discretion.
